When Apotex Inc., a company based in Ontario challenged Viagra patent rights in Canadian court, the court declared that the availability of a Ontario-based Apotex manufactured Viagra would doubtlessly violate Viagra patent rights and hence a generic version of the erectile dysfunction drug Viagra cannot be allowed in the pharmaceutical market.
The federal Toronto court in Canada also made it clear in its ruling that a generic Viagra version can be made available only after 2014 when the patent period of Viagra expires in the region.
